REBATE ELIGIBILITY

*IRRIGATION SYSTEM UPGRADE REQUIRED*  

SMWD requires the irrigation system to be a low flow system, such as drip or high efficiency, low precipitation rotating sprinkler nozzles.  We also offer rebates for these devices!  Apply for our drip rebate BEFORE purchasing the system.  For rotating sprinkler nozzles, you can apply for the rebate AFTER purchasing them.  Rotating sprinkler nozzles can be found at home improvement retail centers or irrigation supply stores (e.g. Hydro-Scape, Ewing Irrigation, Imperial Sprinkler Supply).  District staff will check for this irrigation system at the time of the Post Inspection.

REBATE PROGRAM DETAILS

SMWD will provide a rebate to single-family residents who convert their front yard to a CA native garden using a My Avant Garden landscape kit.  Rebate amounts will vary based on the type of kit purchased and installed (based on area of landscaping) and the type of vegetation being converted. This rebate is not restricted to just turf removal!  SMWD will provide a rebate of up to $625 for homes converting grass but will also provide a rebate of up to $350 to homes converting other landscaping (e.g. tropical or medium water use shrubs) to CA native plants.  New homes that are installing new landscaping can also receive a rebate of up to $350.  District staff reserves the right to conduct a Post Inspection to verify customer eligibility and rebate amount.  SMWD will provide only 1 rebate for either the "Poppy," "Sage," "Laurel," or "Madrone" kit.  However, residents can combine these kits with the "Parkway" kit and receive a rebate for both.  We can also rebate just the "Parkway" itself (up to $85) if customers only convert their parkway strip.  If you live in an HOA, make sure to go through your HOA's appropriate review process. 

 

 


 

Rebate Program Process

  • Photograph your landscape before starting your project.  Take a minimum of 3-5 photos that clearly depict the pre-existing conditions.  Rebate eligibility will be partly based on these photos.
  • Measure your project area and determine the total area in square feet.
  • Explore www.MyAvantGarden.com to learn about their CA native landscape conversion kits.
  • Purchase your My Avant Garden kit.  Save a copy of your Order Confirmation email.
  • Install your My Avant Garden Kit!  You must install your kit within 90 days of purchasing.  The District reserves the right to deny applications if projects exceed 60 days.  Contact the District to request an extension.
  • Photograph your landscape after finishing your project.  Take a minimum of 3-5 photos.
  • Complete the SMWD Landscape Kit Rebate Application within 90 days of purchase.  This on-line application will require contact and address information, several photos of the pre-existing and final landscape, a copy of your order confirmation email and acceptance of the Terms and Conditions.
  • District staff will review your application, and may contact you to schedule a post-inspection.  The District reserves the right complete a post-inspection to verify project install and eligibility.  Photos and measurements may be taken to verify eligibility and determine final rebate amount.
  • District staff will send you a Rebate Eligibility Email indicating that either your rebate is being processed or that you are not eligible for a rebate.
  • Allow at least 6 weeks to receive your rebate check after receiving your Rebate Eligibility Email.
  • Enjoy your new landscape!

Rebate Eligibility Rules

  • Kit must be installed at site within 90 days of purchasing.  The District reserves the right to deny applications if projects exceed 60 days. 
  • The converted landscape must follow the design provided in the kit.  Minor modifications may be allowed if they match the intent and nature of the original kit design.
  • The irrigation system must be a low flow system, such as drip irrigation or high efficiency, low precipitation rotating sprinkler nozzles (rebates available!).  
  • Exposed soil must be covered with 2-3" of mulch.  This is important for minimizing runoff from your front yard.
  • Rebate amount will be based on a combination of the “before” photos provided in the application and aerial imagery to verify area and landscape composition.
  • If a resident would like to participate in both this Landscape Kit Rebate Program and a regional turf rebate program, the resident’s turf rebate application status must be active.  Turf rebate applications on a waitlist are not considered active.  

 


 

Rebate Program Terms, Conditions, and Release

 

PROGRAM TERMS AND CONDITIONS

  • Participants and site locations must be customers of Santa Margarita Water District (District).
  • Program funds are limited. This offer is limited and is available on a first-come, first-served basis to eligible participants while program is in place and/or funding lasts.
  • Only one (1) application may be submitted per single-family residence.
  • The owner of the single-family residence must be the person applying for the rebate.
  • District reserves the right to conduct PRE and POST-installation inspections of the landscape to verify the condition of the landscape, the square footage of the landscape, and the plant palette composition.  These will be used to determine which category of funding the landscape is eligible for – Replacing Lawn or Replacing High Water Shrubs/New Landscaping.
  • The District reserves the right to cancel applications if landscape kits are not installed within 90 days of purchase.
  • The converted landscape must follow the design provided in the kit.  Minor modifications may be allowed if they match the intent and nature of the original kit design.
  • The irrigation system must be a low flow system, such as drip irrigation or high efficiency, low precipitation rotating sprinkler nozzles.  Exposed soil must be covered with 2-3" of mulch.  
  • Rebate funding will be based upon the type of kit purchased, the type of landscape being replaced by the kit, the area converted, whether a low flow irrigation system has been installed and whether the new landscaping follows the design provided in the kit.
  • Rebates may be considered taxable income, and a signed IRS W-9 form will be required for rebates of $600 or more.  The District is not responsible for any taxes, penalties, or interest that may be imposed in connection with your receipt of any rebate.
  • The District reserves the right to use PRE and POST-installation photographs for marketing purposes.  Identifying location features, such as address numbers, will not be included in any promotional materials.

RELEASE OF CLAIMS AND INDEMNIFICATION

Neither the District, or its contractors or agents, makes any representation or warranty regarding the services or products that you receive under this Program.  Installation of the landscape kit does not guarantee reduced water use.  By participating in the Program and accepting the rebates provided, you thereby release the District, and their contractors and agents, from any and all claims and causes of action that may arise out of the purchase, installation, and/or use of water efficient devices and landscape kits in connection with this Program.  Any and all claims or causes of action in connection with any defect or failure of performance of any contracted service or installed product or device provided may only be pursued with the participant’s contractor or the appropriate manufacturer/distributor.  The District is responsible for enforcing the terms and conditions of the Program.  The Program participant is responsible for ensuring that the Project complies with all applicable Federal, State and local laws, as well as applicable CC&Rs and/or HOA restrictions.  Quality of work and appearance of the converted area are the responsibility of the participant.  Furthermore, the participant agrees to indemnify, defend and hold harmless the District, and their directors, officers, employees, contractors and agents from all liability and claims of any kind arising out of or related to the purchase, installation, and use of water efficient devices and kits in connection with this Program.
